What does maintenance court do?

If the court finds the person liable for paying maintenance, it will make an order for the amount of maintenance to be paid. The court will also determine when and how maintenance payments must be made.

What is the maintenance court in South Africa?

An application for maintenance can be made against a defendant (person who must pay maintenance) at any Maintenance Court (“court”) in the district where the complainant (person who applies for maintenance) or the child, on whose behalf maintenance is claimed, resides or works.

In our law there is no set amount that a parent should pay for maintenance in respect of their child, and each case is decided based on the situation of the specific family.
