Levies are compulsory, and withholding them because you are unhappy with the body corporate is the one thing that will not work. Arrears attract interest and legal costs, and an owner in arrears usually loses the right to vote on ordinary resolutions.

Who actually decides what
This is where most sectional title disputes start.
- The body corporate is all the owners, and it makes decisions at general meetings.
- Trustees are elected owners who run things between meetings, within the rules.
- A managing agent is contracted to administer, and takes instructions; it does not own the scheme or set the levies.
- Special levies must be properly resolved on, and you are entitled to see the resolution and the budget behind it.
Buying into a scheme
Ask for the annual financial statements, the reserve fund position, and any special levy in prospect before you sign. A scheme with no reserves and an ageing roof will levy you for it after transfer.
Read the conduct rules, particularly on pets, parking, short-term letting and alterations. Disputes in sectional title schemes are referred to the Community Schemes Ombud Service, which is inexpensive and binding, rather than to court. Verified 26 August 2026.
