The department marks the Witbank number as temporary, so check it before relying on it. Two of the mailboxes contain the department’s own spelling errors, Kimberly and Rusternburg, and must be typed exactly as published or the message will bounce.
Several offices publish only an individual advocate’s mailbox rather than an office one, among them Graaff-Reinet, Gqeberha, Mitchells Plain and the Durban provincial office. We give the telephone number and address for those instead, because staff change while the office does not.
What the Family Advocate does
The Family Advocate helps parties reach agreement on disputed custody, access and guardianship. Where they cannot agree, it evaluates their circumstances in the light of the best interests of the child and recommends an outcome to the court.
An inquiry follows an application by the parties. A family counsellor, normally a trained social worker, assists, the parties are interviewed about their circumstances, and the children are interviewed so that they are heard without having to appear in court.
What it cannot do
- It cannot become involved in a matter the court has already finalised.
- It cannot be subpoenaed as a witness for either party, even where its recommendation favours that party.
- Its recommendation is not enforceable unless the court incorporates it in an order.
- It is neutral and cannot act as anyone’s legal representative.
Knowing that before you phone saves a wasted call. If your order is already granted, or you want someone to argue your case, this is not the office.
