The small claims court is free, and lawyers are not allowed to appear in it. That is deliberate: it exists so that ordinary people can recover modest amounts without paying more in legal fees than the claim is worth. You present your own case to a commissioner.

The steps in order

Skipping the first one is why most claims are turned away at the counter.

• Send a written letter of demand first, and keep proof that it was delivered.
• Give the other side the stated time to pay before approaching the clerk.
• Take every document: the agreement, invoices, receipts, photographs and messages.
• The clerk issues a summons and gives you a hearing date.

What it can and cannot hear

There is a monetary ceiling, set nationally and adjusted from time to time, and claims above it belong in the magistrate’s court. Some matters are excluded entirely, including divorce, wills and claims against the state in certain categories.

The decision is final on the merits, so prepare properly the first time. Bring your documents in order, and be able to say plainly what you are owed and why. Verified 26 August 2026.
