Before you sign a will

• Ask what the executor fee will be, and negotiate it before signing. Ask whether it is charged on the gross or net estate.
• You may nominate anyone as executor, including a family member, who may then appoint a professional agent if needed.
• Read the will yourself. A free will drawn up by an institution is a marketing exercise if it also nominates that institution as executor, which is where the money is.
• Two competent witnesses must sign in your presence, and a beneficiary who witnesses can lose their inheritance.

What a will should cover

Guardianship of minor children, which is the provision people most often omit, and what happens to assets left to a minor. Retirement fund benefits are generally not distributed by your will; the fund trustees decide, so keep the fund’s nomination form current.

Tell your family where the original will is kept. A will nobody can find is a will that does not operate, and the estate is then wound up as if there were none.
