Phone before the arrears, not after
A bank restructuring a loan you are still servicing is an ordinary arrangement. A bank chasing an account already handed to collections is a different, harder conversation, and by then a default has usually been reported to the credit bureaux, where it stays for years. The gap between those two calls is often a single missed instalment. If you can see one coming, make the call this week.
What to have ready
- The account number for each facility, and which one is the problem.
- What you can actually afford each month — a real figure, not an optimistic one.
- What changed: lost income, reduced hours, illness, a death in the household. Say it plainly.
- Whether you have credit protection or credit life insurance on the debt. Many Absa credit agreements include it, and retrenchment, disability or death may be a claim rather than an arrangement.
That last point is the one people miss. Ask directly whether the agreement carries credit life cover and what it covers, because claiming on it is cheaper than restructuring.
Get every arrangement in writing
A payment arrangement agreed over the phone and not confirmed in writing is the commonest source of later disputes. Ask for it by email, check the amount, the start date and how long it runs, and keep it. Ask specifically what will be reported to the credit bureaux under the arrangement, because a restructure and a default are recorded differently.
If a third party phones you about an Absa debt
Banks do use external collection agents, so such a call may be genuine. But this is also a well-worked fraud. Never pay into an account given to you on an incoming call, and never confirm your card number, PIN or one-time password to someone who phoned you. Take the caller’s name and reference, hang up, and phone 0860 000 786 or 08600 08600 yourself to confirm the debt exists and where payment goes. A real collector will not object.
Your rights while in arrears
- A credit provider must send you a Section 129 notice before it may take legal steps, and that notice must offer you the option of debt counselling.
- You may apply to a registered debt counsellor at any time before judgment; over-indebtedness is a statutory process, not a favour.
- You are entitled to a settlement figure on request, and to a statement of the account.
- A listing you believe is wrong can be disputed with the credit bureau free of charge, and then with the National Credit Regulator.
Escalation
Complain to Absa first and keep the reference. An unresolved banking complaint goes to the National Financial Ombud Scheme, and a complaint about reckless lending or a credit agreement goes to the National Credit Regulator. Both are free to consumers.
