Standard Bank does not publish a separate phone number for a “legal department”. For accounts in arrears, collections and recoveries, its arrears page gives 086 100 1868 for home loans, vehicles, credit cards, personal loans and overdrafts, and 0860 007 423 for Diners Club. The arrears page also has a call-me-back form. It asks for your name, surname, ID number, contact number, email address and preferred language.

The legal process when an account is in arrears

  1. Section 129 letter (letter of demand): a legal notice under the National Credit Act that sets out your balance and arrears and the options open to you. Standard Bank calls it your last chance to bring the account up to date.
  2. Summons: drafted by the bank’s attorneys, asking the court to grant judgment against you.
  3. Judgment: you must pay the amount in the judgment, or the bank can apply to repossess movable or immovable assets. A judgment appears on your credit record.
  4. Warrant of execution: allows the bank to take and sell the asset. You remain liable for any shortfall.
  5. Sale in execution: the sheriff sells the asset at a public auction, often below market value.

Standard Bank says that while an account is in arrears you will receive calls and messages from the bank, its collection agents and its attorneys.

Arrangements to avoid legal action

  • Promise to Pay: repay your arrears plus your instalment over up to three months. If you break the arrangement, legal action can start.
  • Respread of arrears: the arrears are spread over several months and added to your instalment, so your monthly payment goes up but the account is no longer in arrears.
  • Payment holiday: a break of usually 1 to 3 months from all or part of your instalment. Interest and fees still build up, so you end up paying more.
  • EasySell: Standard Bank’s platform to help you sell a home or vehicle for the best price instead of it going to auction.

What arrears can affect

Standard Bank’s arrears page warns that a missed or partial payment can stop a new credit application from being approved, because your ability to repay on time is checked when you apply. Linked facilities may also be cancelled. It suggests sticking to a strict budget and paying by debit order to avoid falling behind. If you cannot cover all your debts after your monthly expenses, it suggests a consolidation loan, and a consultant will call you back to discuss which option suits your situation.

Insurance and credit life sales and services go through 0860 123 999. Standard Bank does not publish an “ITC department”.
