Contracting your vehicle to a transporter
Owner driver arrangements fail on the details, and the details are rarely discussed until something goes wrong. Get all of this in a written contract before the first load.
- How you are paid, and when. Per load, per kilometre or per ton, and how many days after delivery or after the client pays. The difference between those two decides whether you can survive a slow paying client.
- Who carries fuel, tolls, maintenance and tyres. These are the whole margin on a truck, and an attractive rate can be loss making once they are yours.
- Whose insurance covers the cargo, and whose covers the vehicle. Confirm the goods in transit policy actually names your vehicle, and get that in writing from the insurer, not from the transporter.
- Who is liable for damage, shortages and demurrage. A clause making you responsible for a client’s standing time can wipe out a month.
- Minimum work, or none. Establish whether any volume is guaranteed, because a contract with no minimum is not income.
- How the agreement ends, on what notice, and what happens to money owed at that point.
Before you sign
- Check the company on the CIPC register and confirm the person signing has authority to do so.
- Ask other contracted operators whether they are paid on time. This tells you more than any document.
- Do not hand over your vehicle registration papers. A copy is enough for any legitimate purpose.
- Keep every waybill and proof of delivery. If payment is disputed, those are your invoice.
- Have the contract read by someone independent before signing, particularly the liability and termination clauses.
If you are not paid
Send a written demand with the waybill numbers and dates, and keep proof that you sent it. For amounts within its limits the Small Claims Court costs nothing and needs no lawyer, which makes it the realistic route for a single unpaid load. Larger amounts need an attorney’s letter of demand.
If you were an employee rather than a contractor, unpaid wages are a CCMA matter instead. The distinction turns on how the work was actually controlled, not on what the contract calls you.
