A child without documents still has the right to be in school
This is among the most important things a parent can know, and it is widely misunderstood by families and sometimes by schools. A school may not refuse to admit a learner, or remove one, simply because the child has no birth certificate or identity document.
- The right to basic education applies to every child in South Africa, and the courts have confirmed that undocumented children may not be excluded from public schools on that basis.
- A school must admit the learner and allow a reasonable period to produce outstanding documents, rather than turning the child away at the gate.
- Work on the documents in parallel. Home Affairs handles late registration of birth, and a school or district can often say what is usually accepted in the meantime.
- If a child is refused, put it in writing and take it to the district office. Do not accept a verbal refusal at reception as the end of it.
- Legal help exists and is free. Legal Aid South Africa, university law clinics and child rights organisations assist with exactly this.
The same applies to fees. A public school may not refuse admission, withhold a report, or exclude a child from activities because of money owed.
What a no fee school may not charge
- No compulsory school fee, under any name. Not a registration fee, not an admission deposit, not a levy.
- A voluntary contribution must be genuinely voluntary, and a learner may not be treated differently because a family does not pay one.
- The national school nutrition programme provides a daily meal. If meals are not being served, raise it with the district.
- An excursion may not be made a condition of promotion to the next grade.
Comprehensive means subject streams
A comprehensive school offers technical, commercial or vocational streams alongside the academic one. Ask which streams actually run in the year you are asking about, since offerings depend on staffing and equipment. Ask too whether mathematics is offered as distinct from mathematical literacy, because that choice at the end of Grade 9 decides what a learner can study afterwards.
Escalation
The principal first, then the school governing body, then the Ekurhuleni district office of the Gauteng Department of Education. Childline is 116, free and 24 hours, and an emergency in progress is 10111. Corporal punishment is unlawful in every South African school and can be reported directly to the district or to SAPS.
