An unfair dismissal must be referred within thirty days, and that clock is the single most common reason a good case dies. Referral to the CCMA is free, and you do not need a lawyer to do it.

Three different places

Sending a dispute to the wrong one costs the time you do not have.

• A labour centre deals with unemployment insurance, compensation claims and inspections.
• The CCMA or a bargaining council deals with dismissals and unfair labour practices.
• The Labour Court hears reviews and certain categories of dispute referred to it.
• Where a bargaining council covers your sector, the dispute goes there rather than to the CCMA.

Preparing the case

Keep the contract, payslips, warnings, the notice of the hearing and any message that goes to the point. Resigning under pressure is not the same as being dismissed, and it is far harder to run, so take advice before writing a resignation letter.

Different deadlines apply to different disputes, and discrimination matters run longer than dismissal ones. Late referrals need condonation, which is granted at a commissioner’s discretion and never guaranteed. Verified 26 August 2026.
