Inspection and Enforcement is the line for unsafe or unlawful working conditions, which is a different matter from a benefits claim and a different desk.
Labour centres do not settle disputes
A common and costly misunderstanding. The Department administers benefits and enforces workplace law. It does not adjudicate whether your dismissal was fair.
- Unfair dismissal or an unfair labour practice goes to the CCMA, and there are strict time limits, usually measured in weeks from the dismissal.
- Unpaid wages or leave pay can be taken up with a labour inspector, and that is the Department’s role.
- UIF benefits are claimed regardless of the fairness of the dismissal, and delay in claiming is the commonest reason for refusal.
- Injury at work goes to the Compensation Fund, which pays, not to your employer.
Every one of these services is free. Nobody may charge you to lodge a UIF claim, report an injury or bring a case, and anyone offering to for a share of the payout is defrauding you.
