Task scope

Bond cancellation is the process of closing a home loan and removing the bond registered over the property at the Deeds Office. It normally happens when you sell, when you refinance with another bank, or when you settle the loan in full.

Two separate things have to happen, and people conflate them. Settling the outstanding balance closes the loan account. Cancelling the bond is a registration action at the Deeds Office handled by a cancellation attorney. A paid-up loan with an uncancelled bond still shows a bond over your property.

Route

0860 111 007 is the single number Absa publishes across its home loan pages – for taking out a bond, managing an existing one, requesting a settlement figure and giving notice of cancellation. There is no separate cancellations line, so state at the start of the call that this is a cancellation.

Requirements

Give 90 days’ written notice, and give it early. Under the National Credit Act a credit provider may charge up to three months’ interest in lieu of notice where you settle without giving the full notice period. Giving notice the moment you list a property – rather than when a sale goes through – is the single decision that saves the most money, and notice costs nothing if the sale falls through.

You will need the bond account number, the property details, and identification. Absa issues a settlement quote valid to a stated date – it expires, and a quote that lapses before registration has to be reissued.

Steps

You do not choose the cancellation attorney – the bank does. That firm acts on Absa’s instruction, and its fees are payable by you as the borrower. It is a separate firm from the transferring attorney handling the sale, and the two must talk to each other; delays often sit between them rather than at the bank.

Get written confirmation at the end. It is the document that proves the debt is settled and the bond removed, and it is what you will need if the account ever reappears on a credit report.

Escalation

Chase a stalled cancellation on 0860 111 007 with the bond account number, the notice date and the attorney’s reference. If the delay is at the attorney rather than the bank, say so – the bank instructed them.

Beyond Absa, a banking or credit dispute goes to the National Financial Ombud Scheme free of charge, and the conduct of a credit agreement – including penalty interest charged in lieu of notice – to the National Credit Regulator. Conduct by the attorney is a matter for the Legal Practice Council. A credit bureau record that still shows a settled bond goes to the bureau and, if unresolved, to the National Credit Regulator.
