Before signing a mandate or paying a deposit, ask for the Fidelity Fund Certificate. Every property practitioner and every firm must hold a valid certificate for the current year, and one that has lapsed is not a technicality: a practitioner without a valid certificate may not trade and is not entitled to remuneration for that period. The certificate names the year, so check the date rather than accepting a photograph of an old one.
Deposits and rental monies must be held in a trust account, not an ordinary business account. Ask which trust account your money is going into and get the reference in writing. If a dispute cannot be settled with the office, the Property Practitioners Regulatory Authority is the body that registers and disciplines estate agencies and handles complaints against them, and it also administers the fund that compensates consumers for theft of trust money.
