Check the registration before you sign anything
Debt review is a formal legal process under the National Credit Act, not a service anyone may simply offer. A debt counsellor who is not registered with the NCR cannot lawfully place you under debt review, and paying one is money gone.
- Ask for the NCRDC number. Registered debt counsellors have one, in the form NCRDC followed by digits, and they are required to give it.
- Look it up on the NCR’s Register of Registrants rather than trusting a certificate image. Certificates are trivially forged; the register is not.
- Confirm the name matches. A trading name that differs from the registered name is worth a question, not an assumption.
- Phone the NCR on 0860 627 627 if anything does not line up.
Practices the regulator has warned about
The NCR has publicly warned consumers about misleading and prohibited practices by debt counsellors. The patterns worth recognising:
- Cold calls offering to “remove” you from debt review. Exiting debt review is a legal process with defined routes, not something bought over the phone.
- Promises to clear your credit record. Nobody can delete accurate information from a credit bureau. What is listed comes off when the prescribed period expires.
- Upfront fees into a personal account. Debt counselling fees are regulated and paid through proper channels, never to an individual’s bank account.
- Pressure to decide immediately. A legitimate counsellor will let you check their registration first, because they expect you to.
Payments under debt review go to a registered payment distribution agency, not to the counsellor personally. If you are asked to pay your restructured instalment into someone’s own account, stop and phone the NCR.
What debt review actually does
- It restructures what you pay across your credit agreements into one reduced monthly amount, ordered by a court or tribunal.
- It protects your assets from being seized while you keep up the restructured payments.
- You cannot take new credit while under review, and the status is flagged at the credit bureaus until you complete it and receive a clearance certificate.
- It is not debt forgiveness. The debt is repaid, over longer, at a lower instalment.
