Attorneys and debt collectors are regulated differently
This matters if you want to complain about how you are being treated.
- Registered debt collectors answer to the Council for Debt Collectors, which sets a code of conduct and caps what they may charge.
- Attorneys answer to the Legal Practice Council instead. A law firm collecting a debt is practising law, not operating as a registered debt collector.
- The creditor behind the letter, if it is a credit provider, is registered with the National Credit Regulator, and the National Credit Act governs the underlying agreement.
Send a complaint to the right body or it goes nowhere. Ask, in writing, who the firm acts for and in what capacity, because the answer determines which regulator applies.
Before you pay anything
Two rules do more to protect people than any phone number on this page.
- Ask for proof of the debt in writing. You are entitled to know who the original creditor was, what the amount is made up of, and on what agreement it is based. Do this before discussing payment.
- Understand prescription before you acknowledge anything. Most consumer debt in South Africa prescribes after three years without acknowledgement or payment, and a prescribed debt cannot be enforced. Making a payment, or admitting the debt is yours, can restart that clock. Old debts are sometimes pursued precisely in the hope of a small payment that revives them.
Never pay into a personal bank account. A law firm collects into its trust account, not an individual’s. Banking details that differ from those on the official letterhead are a reason to stop and phone the office on the numbers above.
If a court process has started
- Do not ignore a summons. Ignoring it is how a default judgment happens, and a judgment is far harder to undo than a defence is to enter.
- A deduction from your salary requires a court order. An emoluments attachment order must be granted by a court, and there are limits on what may be taken.
- Get legal advice if you cannot pay. Legal Aid South Africa and university law clinics assist people who cannot afford an attorney, and debt review under the National Credit Act is a formal alternative to being sued.
